What
is Law ? :-

 

 

    • Definition of Law:

      Set
      of obligations to each other.

      i.e. rights or duties to each other.

 

    • Obligations may be:

      Created.

      Imposed.

 

    • Created obligations are dealt by the
      branch of law known as contracts and dealt
      with for remedial measures under:

      Civil Courts exercising jurisdiction over
      Contracts,sale of goods, property, agency,
      insurance, banking, negotiable instruments etc.

      MRTP Courts, Company law board etc.

      Consumer Protection act.

 

    • Imposed obligations are dealt by
      criminal law:

      IPC, CrPC, TADA, COREPOSA etc.

      Torts.

      Welfare legislation of state: IDA,
      Factories act, payment of Bonus etc.

      Tax collection to run the state:
      income tax, wealth tax, gift tax,
      sales tax, excise, customs, FEMA
      etc.

 

    • Consumer protection Act:

      Mixture of welfare legislation and civil
      remedy to give better deal to unorganized customers.

      To improve quality to goods produced by
      our country.

      To improve quality of services
      provided in our
      country.

 

    • All along after independence India had
      shortages of goods and services so they
      were protected by various kinds of
      protective legislation example: Customs,
      FEMA, IDRA.

      But now there is no dearth of goods and
      services available to its people so we
      must improve their quality so that
      every person gets better quality of goods
      and services and India can export such quality goods and services to other
      countries so as to enter in free
      international economy, Indian currency is
      fully convertible like dollar and pound
      sterling.

 

    • The thenUnion Health minister Mr. Bharadwaj
      stated on the floor of parliament that
      doctors are not under the ambit of
      CPA-1986. Mr. Manishanker Aiyer assured
      IMA that late Mr. Rajiv Gandhi did not want doctors service to be include in the
      said act. But after the legislation is
      passed it is left to judicial discretion
      of judges who administer the law as to
      what is the true interpretation of law.
      Discussions of individual politician have
